2.57 Recovery of amounts due to the Government

2.57.1 Bare Act Provision:

34. Recovery of amounts due to the Government.―Any amount due to the Government from any person under this Act may, on a certificate issued by the Director-General or an archaeological officer authorised by him in this behalf be recovered in the same manner as an arrear of land revenue.

2.57.2 Interpretation:

Section 34 of the Ancient Monuments and Archaeological Sites and Remains (AMASR) Act, provides a mechanism for recovering amounts owed to the Central Government under the Act. If a person owes money to the Central Government under the AMASR Act e.g., fines for violations under Section 30 or compensation disputes, the Director-General of the Archaeological Survey of Bharat or an authorized archaeological officer can issue a certificate for the amount owed. This amount can then be collected using the same legal process used to recover unpaid land revenue e.g., through government seizure of property or assets. This provision ensures that financial obligations under the AMASR Act are enforceable by empowering the Central Government to recover dues efficiently through established land revenue recovery mechanisms, thereby supporting the Act’s implementation and protecting Bharat’s cultural heritage.
